Supertech Twin Towers: Supreme Court says Twin Tower flats must be returned to buyers before February 28

The Supreme Court has said that home buyers who have paid for a flat in the 40-storey Twin Towers of Supertech in Noida under a court order must repay on or before February 28.

Advocate S Ganesh, appearing for Supertech, submitted that 38 prosecution petitions have been filed for refund. Agarwal submitted that there are 38 home buyers and if the home buyer has a home loan, the developer can settle the home loan account by March 31. Counsel for some homebuyers has asked the court to reconsider the agreement reached between their client and the developer. The bench asked that we also have to do some fairness for the developers. If there is a settlement, how can we intervene?

Justice Kant insisted that the dispute should be settled, otherwise the matter would continue. Ganesh has requested the court not to repeat the settlement between the home buyer and their client. The apex court has said that home buyers have to pay the arrears on or before February 26. The bench further said that in cases where homeowners have paid for the flat after taking home loan from the bank, the developer has to settle it before March 3 and get a NOC from the financial institution before April 10.
